Complaint Type: Small Claims
Plaintiff: Chucky TwoSneakas
Self Rep: no
Lawyer Name: Saul Goodman Esq
Respondent: BCSO
Claim:
Plaintiff Chucky Sneakas seeks damages arising from the actions of a BCSO deputy who deployed a Taser against him while he was actively climbing a ladder approximately eleven stories above ground level. The Taser deployment caused Plaintiff to fall from the ladder, resulting in severe injuries including a broken arm, fractured collarbone, and significant back injuries. Following the fall, responding BCSO personnel allegedly failed to provide or summon immediate medical assistance, demonstrated deliberate indifference to Plaintiff's medical condition, failed to advise Plaintiff of his Miranda rights prior to custodial interrogation and arrest, and transported Plaintiff directly to jail despite the obvious severity of his injuries. Plaintiff asserts that the actions of the involved deputy and the conduct of responding officers constituted negligence, excessive use of force, and failure to provide a duty of care.
Demand:
Plaintiff demands compensatory damages in the amount of $750,000 for physical injuries, pain and suffering, medical expenses, loss of income, emotional distress, and diminished quality of life resulting from the incident. Plaintiff further requests reimbursement of all past and future medical treatment costs associated with the injuries sustained from the fall, including treatment for a broken arm, fractured collarbone, and severe back injuries. Additionally, Plaintiff seeks dismissal of any charges arising from the incident, a formal internal investigation into the conduct of the involved deputy, termination of the deputy responsible for deploying the Taser, and any other relief the Court deems just, proper, and equitable under the circumstances.
