CIVIL COMPLAINT FOR DAMAGES, ABUSE OF POWER, AND VIOLATION OF CIVIL RIGHTS
I. PARTIES

Plaintiff, Chung DaSilva, is a lawful resident of the State of San Andreas.

Defendant Los Santos Police Department (LSPD) is a law enforcement agency operating within Los Santos.

Defendants John Doe Officers 1–5 are sworn officers of LSPD whose identities are presently unknown but will be amended upon discovery.

II. JURISDICTION AND VENUE

This Court has jurisdiction over this matter as the events giving rise to this complaint occurred within the State of San Andreas.

Venue is proper in Los Santos County as the alleged misconduct occurred at the Rockford Hills Police Department and surrounding areas.

III. STATEMENT OF FACTS

On or about January 1, 2026, Plaintiff was lawfully present at the Diamond Casino, engaging solely in legal gambling activities.

Plaintiff was not involved in, present for, nor connected to any criminal activity including, but not limited to:

Kidnapping of an emergency worker

Kidnapping

Bank robbery

Attempted bank robbery

Felony evading arrest

Firearms-related offenses

No evidence existed placing Plaintiff at the scene of any alleged crimes.

Upon exiting the casino, Plaintiff was unlawfully detained and arrested by an undercover LSPD officer under the pretext of “recklessly riding a BMX.”

Plaintiff was transported to Rockford Hills Police Department, where he was formally charged with the above crimes without probable cause or supporting evidence.

As a result of these false charges, Plaintiff was sentenced to over forty (40) days of incarceration and fined $36,500.

While detained, Plaintiff was subjected to unprofessional, abusive, and discriminatory conduct by LSPD officers, including but not limited to:

Racist remarks

Deliberate mischaracterization and twisting of Plaintiff’s statements

Verbal harassment, including being referred to as “good boy” and “bitch”

Such conduct constitutes harassment, degradation, and abuse of authority while Plaintiff was in custody.

Additionally, one LSPD officer posted a Life Invader message mocking Plaintiff and his family, stating:
“DaSilva can suck my nuts say bye to Chung”, accompanied by a photograph of the officer.

This public post was made while Plaintiff was in custody and was intended to humiliate, intimidate, and harass Plaintiff.

Officers further alleged they overheard radio communications implicating Plaintiff, despite never obtaining a warrant nor lawfully seizing Plaintiff’s radio equipment.

The use of unlawfully obtained information constitutes a clear abuse of power and a violation of Plaintiff’s rights.

Plaintiff suffered emotional distress, reputational harm, financial loss, and psychological trauma as a direct result of Defendants’ actions.

IV. EVIDENCE

Plaintiff possesses substantial evidence supporting these claims, including:

CCTV footage from Rockford Hills holding cells

Helmet-mounted video recordings worn by Plaintiff during the incident

Said evidence corroborates Plaintiff’s lawful conduct, unlawful arrest, and the misconduct of Defendants.

V. CAUSES OF ACTION

Count I – False Arrest and False Imprisonment
21. Defendants knowingly detained and incarcerated Plaintiff without probable cause.

Count II – Abuse of Power and Misconduct
22. Defendants exceeded their lawful authority through harassment, discrimination, and unlawful evidence gathering.

Count III – Violation of Civil Rights
23. Defendants deprived Plaintiff of due process, dignity, and lawful protections under San Andreas law.

Count IV – Intentional Infliction of Emotional Distress
24. Defendants’ conduct was extreme, outrageous, and caused severe emotional trauma.

VI. DAMAGES

Plaintiff suffered the following damages:

Unlawful incarceration exceeding 40 days

Monetary loss totaling $36,500

Emotional distress and psychological trauma

Reputational harm

Loss of liberty and enjoyment of life

VII. PRAYER FOR RELIEF

WHEREFORE, Plaintiff respectfully requests that this Court:

a. Order full reimbursement of all fines paid ($36,500);
b. Award monetary compensation for false imprisonment and emotional distress;
c. Issue formal reprimands and disciplinary action against the involved officers;
d. Declare Defendants’ actions unlawful and in violation of Plaintiff’s rights;
e. Grant any further relief the Court deems just and proper.
