On 19th of the august, I was stopped by the San Andreas Police Department for speeding. I admit I was driving 15 miles per hour over the speed limit, and I cooperated fully with the officers. they then told me to follow them to the police station, after explaining I wanted eyes on my car at all times to make sure procedure was followed, I was placed in handcuffs and detained and taken into a cell. at which point my firearm was seized and no badge number was yet to be presented to me.

At that point, my vehicle which was parked out front of the police station was no longer under my control. It was the responsibility of the officers on scene to secure it. Instead, while I was detained, my vehicle was stolen in full view of 8 law enforcement officers, the Officers admitted that they lost sight of the vehicle for several blocks before regaining visual and then later recovered the vehicle.

When the vehicle was later recovered, the officer came down to my cell and immediately told me my car was impounded (I was only detained at the time, and had no information about it as the officer left me in the cell) the police claimed they found ten boxes of marijuana inside. However, because the car was stolen while I was in custody, there is no way to prove that those boxes were there before the theft. During the time it was out of both my control and police control, anyone could have placed those items inside.

Furthermore, while I was detained, the officer told me I would have access to legal counsel downstairs. When I arrived, there were no lawyers present — only the District Attorney’s office. I was left without representation at a critical stage.

This entire situation was the direct result of officer negligence. Once I was handcuffed, they had a duty to secure both me and my property. Their failure to do so led to the theft of my car, the planting or mishandling of alleged evidence, and serious charges against me that have resulted in the threat of prison time and heavy fines. a max prison sentence and 80,000 USD fine.

Because of these events, I am filing this civil complaint. I believe the officers acted negligently, failed in their duty of care, and violated my right to fair treatment and legal counsel. I am seeking accountability and damages for the harm caused to me.

1 = as shown, my vehicle was out front in police custody (blue van) where at the time I was detained, and told there would be a public defender for me.
2 = I was placed in a cell while being DETAINED, and had my firearm taken
3 = they informed me that my car was stolen in their posession, and at a later stage was recovered, impounded and found with weed.
