NOTICE OF CIVIL ACTION
NATURE OF CLAIM:
Plaintiff Rextin Sextin hereby files this civil action against the Blaine County Sheriff’s Office for violations of lawful search and seizure procedure, unlawful search of person, and damages resulting from improper investigative conduct.

STATEMENT OF FACTS
Plaintiff is a resident newly arrived to the City of Los Santos and surrounding Blaine County areas.
On or about a recent interaction with deputies of the Blaine County Sheriff’s Office, Plaintiff was detained and investigated in relation to alleged Class 2 Manufacturing offenses.
During said investigation, deputies conducted a direct search of Plaintiff’s person prior to properly investigating or searching the involved vehicle.
Deputies lacked sufficient individualized probable cause to justify an immediate personal search of Plaintiff independent of the vehicle investigation.
Plaintiff did not provide informed consent for such search and was subjected to investigative actions outside reasonable procedural standards.
Following the search, Plaintiff was charged with three counts of Class 2 Manufacturing.
Plaintiff asserts that evidence obtained as a result of the unlawful search constitutes fruit of the poisonous tree and should therefore be considered inadmissible in subsequent criminal proceedings.

Plaintiff alleges the following:

Unlawful Search and Seizure
Violation of Procedural Rights
Improper Investigative Conduct
Emotional and Reputational Damages

Demand:
Plaintiff respectfully requests that the Court:

Review the legality of the investigative stop and search conducted by BCSO deputies;
Suppress any evidence obtained through the unlawful search of Plaintiff’s person;
Award compensatory damages in an amount deemed appropriate by the Court;
Order reimbursement for any seized property, legal expenses, or financial losses arising from the incident;
Grant any further relief the Court finds just and proper.
