[2026-CM-652580-GD] RJ Rincon v. BCSO
Posted: Sat Mar 14, 2026 5:07 am
Complaint Type: General Dispute
Plaintiff: RJ Rincon
Self Rep: no
Lawyer Name: Any willing to represent
Respondent: BCSO
Claim:
I was a passenger in Maria Barela's car, and sheriff S5-92 pulled us over. We pulled over to the right almost immediately. The sheriff asked for Maria's ID and then failed to state why he was pulling us over. Next, he took her out of the car, and put her in the back of his car, failing to state why. S5-92 proceeds to search her without reason and takes the bullets out of her gun, which belonged to her, and let her go. Then, he walks over to me on the passenger side and asks me to step out and searches me too, failing to ask me for my ID. He takes away my gun, and his sheriff partner S4-93 pulled onto scene and followed us to the sheriff department. I ask S5-92 why we got pulled over, and he finally tells me that it was for speeding. I asked why I was being searched as a passenger for a speeding ticket, and he stated that Maria's car came back stolen. However, the car did belong to Maria. I told S5-92 this information and he stated that he would give me a reduction, even though he illegally searched me, due to it being her car. On top of this, S5-92 stated that I was speeding even though I was a passenger, and he stated that doesn't care if I am a passenger or not. Finally, he tries to book me for felony to evade arrest, and that is when S4-93 pulls up to interfere and let me go, even though S5-92 already took all of my personal belongings. S5-92 even went as far as saying to just leave me without returning any of my personal belongings.
Demand:
Compensation for illegal search and seizure of personal belongings and poor conduct from S5-92. I would also like for disciplinary action to be taken against S5-92.
Witnesses: Maria Barela
BCSO S4-93
Evidence:
- Dash cam from Maria Barela's car
- Dash cam from S5-92's car
- Security cam from cell in sheriff department
- Body cam footage from S4-93 and S5-92
