Officers charged Mr. Myspace with assault with a deadly weapon due to Mr. Myspace following a female down the road with his firearm out. At no point did Mr. Myspace shoot or attempt to hurt anyone with his firearm. Nobody got hurt in this process. Mr Gerald Spence was the DA on scene with supervision by Tommy Tenmenn, Mr. Myspace had Dylan Cross defending him.

The correct charge in this scenario should have been brandishing a firearm, as at no point he shot anyone, hit anyone with his firearm.

**Brandishing a weapon:** The act whereby an individual holds, points, waves or carries out other means of gesture with a item or firearm capable of causing harm.

**Assault with a deadly weapon** The use of any weapon to carry out an assault with force likely to produce great bodily injury. Revoke Weapons license if applicable


As you can see the charge that matches what Mr. Myspace did is brandishing a weapon as all he did was have it out and point it. At no point did he use his weapon that could produce force to likely carry out a bodily injury.

Demand:
Mr. Myspace is demanding 50.000$ due to the time hes missed out on whilst he was in prison, the trauma it has caused him and the fine he received due to this incorrect charge.
